Gardeners Greenwich Service Terms and Conditions

These Terms and Conditions set out the basis on which Gardeners Greenwich provides gardening and related services to residential and commercial clients. By making a booking or allowing work to commence, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order for any services.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings given below:

Client means the individual, company or organisation requesting the services.

Company means Gardeners Greenwich, providing gardening and related services within its service area.

Services means any gardening, garden maintenance, landscaping, lawn care, hedge trimming, planting, clearance or other services supplied by the Company to the Client.

Visit means any attendance by the Company or its gardeners at the Client's property to provide the Services.

Contract means the agreement between the Client and the Company for the provision of Services, incorporating these Terms and Conditions.

2. Scope of Services

The Company provides a range of gardening and garden maintenance services including, but not limited to: lawn mowing and lawn care, hedge trimming and pruning, planting and border maintenance, seasonal tidy-ups, general garden clearance, and other related gardening tasks as agreed with the Client.

The exact scope of Services for each Visit will be confirmed at the time of booking, by written quotation, or by a service schedule agreed between the Client and the Company. Any additional work requested by the Client on the day of the Visit will be carried out at the Company’s discretion and may be subject to additional charges.

3. Booking Process

3.1 The Client may request Services by contacting the Company and providing details of the property, the nature of the gardening work required, and preferred dates and times for a Visit.

3.2 The Company may provide an estimated price based on information supplied by the Client, or it may recommend an on-site assessment. All estimates are given in good faith but are not binding until confirmed in writing as a quotation or booking confirmation.

3.3 A booking is deemed accepted and a Contract formed only when the Company confirms the Visit or ongoing service schedule, whether verbally or in writing. The Company reserves the right to decline any booking request without providing a reason.

3.4 For larger projects or regular maintenance arrangements, the Company may issue a written quotation or service agreement. Acceptance of the quotation, or instruction to proceed, constitutes acceptance of these Terms and Conditions.

4. Access and Client Obligations

4.1 The Client must ensure that the Company and its gardeners have safe and reasonable access to the property and all relevant garden areas at the agreed times. This includes ensuring that gates, side entrances and any shared access routes are unlocked or otherwise accessible.

4.2 The Client must inform the Company in advance of any hazards, particular risks, or restrictions at the property, including uneven ground, hidden obstacles, ponds, fragile surfaces, pets, or any relevant health and safety concerns.

4.3 The Client is responsible for ensuring that any necessary permissions or consents are obtained, including but not limited to permissions from landlords, neighbours, or local authorities, especially where tree works, boundary features, or shared access areas are affected.

4.4 If the Company is unable to carry out the Services due to lack of access, safety concerns, or failure by the Client to comply with this section, the Company may treat the Visit as cancelled by the Client and may charge a cancellation fee as set out below.

5. Pricing and Quotations

5.1 Prices may be quoted as an hourly rate, a fixed price for a specific job, or a regular service charge for ongoing maintenance. All prices will be communicated to the Client prior to work being undertaken.

5.2 Quotations are based on the information provided and any site visit made by the Company. If the actual conditions are substantially different from those described or assumed, the Company reserves the right to revise the quotation or charge for additional time and materials.

5.3 Unless otherwise stated, all prices are quoted in pounds sterling and are exclusive of any applicable taxes or government charges that may apply.

5.4 The Company reserves the right to adjust its rates and charges from time to time. For ongoing maintenance clients, the Company will aim to provide reasonable notice of any price changes.

6. Payments

6.1 Payment terms will be communicated at the time of booking or as stated on the invoice. Unless otherwise agreed, payment is due on completion of the Visit or upon receipt of invoice.

6.2 The Company may accept various payment methods, such as bank transfer or other recognised means of payment. Details of available payment methods will be provided directly to the Client.

6.3 For larger projects or new Clients, the Company may require a deposit or part payment in advance. Work may not commence until such deposit has been received and cleared.

6.4 If the Client fails to make payment by the due date, the Company reserves the right to charge interest on any overdue amount at a reasonable rate, as permitted by applicable law, and to recover any reasonable costs incurred in pursuing late payment.

6.5 The Company may suspend or cancel future Visits if previous invoices remain unpaid, without liability to the Client for any resulting delay or lack of service.

7. Cancellations and Rescheduling

7.1 The Client may cancel or reschedule a Visit by providing the Company with reasonable notice. Unless otherwise agreed, a minimum of 24 hours notice before the scheduled Visit is required to avoid a cancellation charge.

7.2 If the Client cancels or attempts to reschedule a Visit with less than 24 hours notice, the Company may at its discretion charge a cancellation fee, which may be up to the full cost of the scheduled Visit, to cover time allocated and any loss of opportunity.

7.3 The Company reserves the right to cancel or reschedule Visits due to adverse weather conditions, staff illness, equipment failure, or other circumstances beyond its reasonable control. In such cases, the Company will aim to offer an alternative date and time as soon as reasonably possible.

7.4 For ongoing maintenance contracts, either party may terminate the arrangement by providing written notice in accordance with any minimum term or notice period specified in the service agreement. Where no specific term is stated, a minimum of 14 days notice will normally apply.

8. Weather and Seasonal Conditions

8.1 Gardening services are subject to weather and seasonal conditions. Certain tasks cannot be safely or properly carried out during heavy rain, high winds, extreme temperatures, or prolonged drought.

8.2 The Company will use its professional judgment to determine whether conditions are suitable for the Services to proceed. Where weather conditions prevent a Visit from taking place, the Company will attempt to reschedule the Visit at a mutually convenient time.

8.3 The Company is not liable for any delay, change in schedule, or perceived reduction in garden appearance arising from unavoidable weather-related disruptions.

9. Waste Removal and Environmental Regulations

9.1 The Company complies with applicable UK regulations relating to the handling, transport and disposal of green waste and other materials arising from gardening work.

9.2 Unless expressly included in the quotation or agreed at the time of booking, the standard service does not automatically include removal of green waste from the property. Cuttings and debris may be bagged or placed in designated compost or waste areas on site.

9.3 Where the Client requests green waste removal, an additional charge may apply. Any such charge will reflect the volume of waste, disposal fees, transport distance and time taken.

9.4 The Client is responsible for ensuring that any on-site compost bins or council-provided green waste containers are accessible and suitable for use. The Company accepts no responsibility for waste that cannot be collected by local authority services.

9.5 The Company will not remove or dispose of hazardous waste, contaminated soil, asbestos, chemicals, or any materials prohibited by law or unsuitable for standard green waste disposal.

10. Client Property and Existing Garden Conditions

10.1 While the Company will take reasonable care when working at the Client’s property, some minor disturbance of soil, plants, lawns or existing features is an inherent part of gardening work.

10.2 The Client should remove or clearly identify any fragile items, ornaments, lighting, cables, irrigation systems, or other vulnerable features in the garden prior to the Visit. The Company cannot accept liability for damage to items that were not reasonably visible or appropriately protected.

10.3 The Company is not responsible for existing issues in the garden, such as poor soil, pests, diseases, invasive plants, drainage problems, or structural faults, nor for the subsequent performance of existing plants or lawns affected by such conditions.

11. Liability and Insurance

11.1 The Company will exercise reasonable skill and care in providing the Services and will carry appropriate public liability insurance, as is customary for gardening businesses operating in the UK.

11.2 Nothing in these Terms and Conditions excludes or limits the Company’s liability for death or personal injury caused by negligence, fraud, or any other liability which cannot legally be limited or excluded.

11.3 Subject to the above, the Company’s total liability to the Client for any loss or damage arising out of or in connection with the Services or the Contract, whether in contract, tort, or otherwise, shall not exceed the total fees paid by the Client for the specific Visit or project giving rise to the claim.

11.4 The Company shall not be liable for any indirect, consequential or economic losses, including loss of profit, loss of enjoyment, loss of anticipated savings, or loss of use of the garden or property, arising from the provision or non-provision of the Services.

11.5 The Client is responsible for any damage caused by pets, children, residents, or third parties during or after the Visit, including any interference with freshly laid turf, new planting, or landscaping works.

12. Guarantees and Plant Performance

12.1 Where the Company supplies plants, turf or similar living materials, it will use reputable suppliers and handle such materials with care. However, the Company cannot guarantee the long-term survival, growth rate, or final appearance of any plant or lawn, as these depend on factors beyond its control, including weather, soil, pests, and the Client’s ongoing care.

12.2 Any aftercare advice provided by the Company is given in good faith. The Client is responsible for following watering, feeding, mowing, and maintenance recommendations. Failure to follow such guidance may shorten the lifespan or alter the appearance of plants and lawns.

12.3 Unless expressly agreed in writing, no specific guarantee is given regarding the longevity or particular results of planting or garden improvements.

13. Complaints and Disputes

13.1 If the Client has any concerns or is dissatisfied with any aspect of the Services, they should contact the Company as soon as possible, ideally within 48 hours of the Visit, to allow issues to be investigated and, where appropriate, rectified.

13.2 The Company will consider complaints fairly and may, at its discretion, offer to revisit the property, adjust the work, or provide a partial refund or credit where a genuine shortfall in service is identified.

13.3 These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any dispute arising under or in connection with the Contract shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Data Protection and Privacy

14.1 The Company will collect and use the Client’s personal information only for the purposes of administering bookings, providing Services, managing accounts, and complying with legal obligations.

14.2 The Company will take reasonable steps to keep personal information secure and will not sell or misuse Client details. Information may be shared with gardeners, subcontractors, or professional advisers where necessary to deliver the Services or manage the business, and always in accordance with applicable data protection laws in the UK.

15. Subcontractors and Assignment

15.1 The Company may use suitably qualified and insured subcontractors to carry out some or all of the Services. The Company will remain responsible for ensuring that the Services are provided in accordance with these Terms and Conditions.

15.2 The Client may not assign or transfer their rights or obligations under the Contract without the prior consent of the Company. The Company may assign or transfer its rights and obligations where this does not materially affect the Client’s rights or the nature of the Services.

16. Amendments to Terms and Conditions

16.1 The Company may amend these Terms and Conditions from time to time to reflect changes in law, industry practice, or business arrangements. The updated version will apply to new bookings made after the date of amendment.

16.2 For ongoing maintenance Clients, the Company will aim to notify them of significant changes to these Terms and Conditions where such changes may affect existing service arrangements.

17. Severability

17.1 If any provision of these Terms and Conditions is held by a court or competent authority to be invalid, illegal or unenforceable, that provision shall be deemed modified to the minimum extent necessary or, if modification is not possible, deleted. The remaining provisions shall continue in full force and effect.

18. Entire Agreement

18.1 These Terms and Conditions, together with any quotation, service schedule or written agreement issued by the Company and accepted by the Client, constitute the entire agreement between the parties in relation to the Services and supersede any prior understanding, arrangement or representation, whether oral or written.
